SLIGO CHAMBER of Commerce has asked An Bord Pleanala to rule on whether the 'change of use' at a store in the Carraroe Retail Park is an exempted development.
The store concerned is Homecare and More, which launched itself locally with a highly effective advertising slogan campaign.
The request from the Chamber was lodged last week, according to details released by Pleanala yesterday (Wednesday).
Described as a Section Five case, the Chamber is called the ''referrer'' by Pleanala, which is the statutory planning and local appeals authority.
The planning authority for the Carraroe Retail Park is Sligo County Council.
No decision datePleanala has summarised the Chamber's case as one to decide ''whether or not the change of use (by Homecare and More) -- by reasons of the class and type of goods being sold -- is, or is not, development.....or is, or is not, exempted development.''
No indicative date has yet been offered by An Bord Pleanala for its likely decision.
However, Section 5 of the Planning and Development Act, 2000 suggests that a declaration on the question that has arisen -- and the main reasons and considerations on which it's decision is based -- is due within four weeks of the receipt of the request.
The Chamber request was lodged on March 13th. The 2000 Act appears to provide a three weeks extension where further information is sought.
